Mack J. Morgan, III has vast experience as a trial attorney. For over 25 years, he has concentrated his practice in the litigation of complex business and commercial transactions. He has extensive experience in federal, bankruptcy and state courts, as well as arbitrations and administrative hearings. Mr. Morgan has served as lead trial counsel for trials involving claims of: antitrust, securities, copyright, trademark, breach of contract, bad faith, negligence, lender liability, Uniform Commercial Code, fraud, and breach of fiduciary duty, among others. He has experience in multidistrict litigation, and has extensive experience defending class actions for some of the largest corporations in the United States, as well as experience on the plaintiffs’ side.
In March, 2008, Mr. Morgan obtained a jury verdict in excess of $21 million for the unfair exercise of monopsony power under the Packers & Stockyards Act. In 2007, Mr. Morgan obtained a trial judgment establishing a company's proprietary information to be trade secrets and permanently enjoined the use thereof. Also in 2007, Mr. Morgan excluded, pursuant to Daubert, plaintiffs' accountant and investment banker expert witnesses in a securities class-action alleging in excess of $1 billion in damages, leading to the granting of summary judgment.
