Oklahoma plaintiff awarded $15 million in Botox negligence case

OKLAHOMA CITY — An Oklahoma County jury ruled Tuesday in favor of an Oklahoma City woman who brought a negligence claim against Allergan, Inc., for injuries and damages allegedly resulting from Botox injections.

“We believe this is the first case in the nation in which the jury has found that botulism-type symptoms have been caused by Botox,” said Anton Rupert, director with Crowe & Dunlevy and the firm’s lead counsel for the plaintiff in the case.

Dr. Sharla Helton, represented by Rupert of Crowe & Dunlevy and Ray Chester of McGinnis, Lochridge & Kilgore, L.L.P., was awarded $15 million in damages. The case was tried in Oklahoma State District Court under Judge Barbara Swinton. Helton was the only plaintiff in the case.
