U.S. DOL Wage & Hour Division Questions, Proposes to Withdraw Final Rule for Classifying Workers

Employers hoping for clarification from the U.S. Department of Labor (DOL) on whether workers should be classified as employees or independent contractors for purposes of the Fair Labor Standards Act (FLSA) will have to wait a bit longer. On March 11, 2021, the DOL’s Wage and Hour Division (WHD) announced a proposal to withdraw a final rule issued January 7, 2021, that would have implemented a test for determining a worker’s status under the FLSA.
