Crowe Dunlevy Secures Maximum Recovery for Landowners Following Appellate Victory

Sep 25, 2026

Crowe Dunlevy represented property owners in a dispute against a municipality involving the long-term discharge of sewage onto their property. After an unfavorable jury verdict and an award of attorney fees against the clients, the Firm successfully appealed the case, obtaining a decision from the Oklahoma Court of Civil Appeals vacating both the verdict and fee award based on instructional and evidentiary errors.

Following remand, the Firm negotiated a settlement providing the maximum recovery available under the Oklahoma Governmental Tort Claims Act. In addition to securing compensation for the clients, the litigation prompted corrective actions that resolved the underlying sewage discharge issues affecting the property. The result transformed a complete trial loss into a full recovery and lasting resolution for the clients.
