As you likely have heard, on December 18, 2019, the Fifth Circuit Court of Appeals issued a 2-1 decision upholding a Texas judge’s decision that the Affordable Care Act (ACA) became unconstitutional after Congress reduced the individual mandate penalty for not having health insurance to zero.
