Stark Law Restrictions Loosened to Assist with COVID-19 Pandemic

On March 30, 2020, the Centers for Medicare & Medicaid Services (CMS) provided relief from the strict provisions of the Federal Physician Self-Referral Law, commonly known as the Stark Law, in light of the COVID-19 pandemic. In particular, CMS has indicated that it will waive sanctions for certain financial arrangements among healthcare providers that don’t meet a Stark Law exception.
