How do I help energy companies resolve complex disputes?

Few Oklahoma litigators can match my experience with both upstream production and midstream operations, which gives me critical perspective when resolving royalty issues, contractual disagreements and other complex energy disputes. I have a substantial understanding of the commercial and operational realities of the business, including everything that happens to hydrocarbons after leaving the wellhead, and I wield that to my clients’ benefit.

Bringing deep experience and insights to energy litigation

Brad Welsh has spent more than two decades representing companies in the oil and gas industry, with a focus on complex commercial disputes and putative class actions involving royalty payments, post-production costs, statutory interest obligations, off-lease fuel use and lease viability. He is also particularly knowledgeable in matters involving gas purchase agreements and other marketing arrangements, as well as litigation concerning production in paying quantities. Brad also handles environmental matters arising from oil and gas operations, including pollution and related proceedings before courts and regulatory agencies.

A friend of, and fighting exclusively for, the industry

While some lawyers and firms will attempt to navigate positional conflicts to represent clients having positions contrary to those accepted by the industry, Brad prefers to solely represent industry-side clients, whom he believes are often blamed for situations they did not cause. As he puts it, ” I understand and support this industry, and do not want litigation to interfere with its efforts to provide ample energy for everyone.”

Handling appeals at every stage of a case

In addition to trying cases, Brad has an active appellate practice. Beyond appeals arising from his own matters, he is frequently asked to step into cases that were tried by other lawyers once they reach the appellate courts. His experience allows him to quickly master complex records, identifying those issues most likely to influence the outcome and presenting them clearly on appeal.

Frequently engaged as local Oklahoma counsel in energy disputes

Because of his experience with Oklahoma courts and Oklahoma oil and gas law, Brad is frequently engaged as local counsel by law firms from outside the state. He works closely with trial teams handling significant energy litigation, providing insight into Oklahoma law, procedure and the issues that commonly arise in disputes involving the state’s oil and gas industry.
