Deric McClellanShareholder/Director
Deric McClellan is a shareholder in the firm’s Tulsa office. Deric’s practice includes representation of individuals and businesses in a wide range of commercial disputes in federal, state, tribal, and bankruptcy court. His primary focus is complex business disputes and has worked on a broad range of litigation matters at both the trial and appellate level, including cases involving eminent domain, RICO, landlord-tenant law, products liability, negligence, breach of contract, constitutional torts, non-compete agreements, and riparian rights. Deric has also represented various clients in bankruptcy adversary proceedings in cases involving preference claims, fraudulent transfer claims, and nondischargeability issues.
Deric’s achievements have earned him inclusion in The Best Lawyers in America: Ones to Watch in Commerical Litigation from 2021-present.
Previously, Deric served as a law clerk to the Honorable Stephanie K. Seymour of the Tenth Circuit Court of Appeals and the Honorable John E. Dowdell of the U.S. District Court for the Northern District of Oklahoma. Deric graduated with highest honors from the University of Tulsa College of Law in 2016 and was honored with the Order of the Curule Chair. During law school, Deric served as the Articles Research Editor for the Tulsa Law Review and was named the Oklahoma Bar Association Outstanding Senior Law Student in his graduating class.
He completed his undergraduate studies at Missouri Southern State University with a Bachelor of Business Administration.
Representative experience includes*:
- Lead on motion practice and second chair at trial for an individual in a case involving contractual dispute between company and former employee resulting in a multi-million-dollar jury verdict at trial.
- Represented targets of fraudulent transfer and preference litigation from trustee in matter seeking over $100 million in damages.
- Represented high-profile media personality in individual Chapter 11 adversary case.
- Represented non-profit organization in litigation involving the enforcement of its conservation easement held for the benefit of the Price Tower in Bartlesville, Oklahoma.
- Obtained complete dismissal for failure to state a claim in federal court in a case involving claims brought under RICO, the Fair Housing Act, and the Federal Fair Debt Collections Practices Act
- Obtained directed verdict in bench trial for homeowner in case involving a subcontractor’s breach of contract claim brought against homeowner.
- Obtained directed verdict in bench trial for business owner in case involving claim brought under the Oklahoma Consumer Protection Act.
