Associate Emily Isbill successfully defended a medical marijuana business owner in administrative proceedings brought by the Oklahoma State Bureau of Narcotics and Dangerous Drugs Control (OBNDD). OBNDD alleged that the client, a majority owner of two licensed medical marijuana grows, was a prohibited “straw party” under Oklahoma law and sought to revoke two existing registrations while denying a third application. Through witness preparation, strategic cross-examination, and a detailed analysis of the statutory requirements, Emily established that OBNDD lacked evidence to support its claims and exposed key flaws in the agency’s interpretation of the law. Following the State’s presentation of evidence, the administrative law judge questioned whether OBNDD had met its burden of proof, and the agency dismissed both revocation actions. The result preserved three critical business registrations and allowed the client to continue operating her medical marijuana businesses.
