Recent Legislation Clarifies the Government’s Ability to Reach Data Stored Overseas

Congress recently passed the Clarifying Lawful Overseas Use of Data Act (CLOUD Act), which clarifies the ability of law enforcement to reach data stored overseas. Since 1986, the U.S. government has been able to access data stored within the United States using the Stored Communications Act (SCA). But whether the SCA allowed the government to access data stored overseas remained an open question. In fact, that question was the subject of a then-pending Supreme Court case, United States v. Microsoft. More.
