Mere days after Nov. 5, 2021, when the Occupational Safety and Health Administration (OSHA) released an Emergency Temporary Standard (ETS) establishing requirements on COVID-19 mandatory vaccination and testing for employers with 100 or more employees, the Fifth Circuit Court of Appeals in New Orleans issued a temporary injunction staying the enforcement of the ETS. That was just one of more than 25 lawsuits filed by states challenging the standard, leaving employers to wonder about the ultimate fate of the ETS, and more importantly, whether and when to begin preparations for implementing its requirements.
