How do I help clients with their litigation, regulatory, and other matters?

I steer clients through the complicated intersection of energy development, environmental regulation, property rights and litigation. I like to understand the full picture of a client’s business so I can anticipate problems before they become urgent and give advice that makes sense in the context of exactly what the client wants to accomplish. Whether I’m helping develop a project or litigating a dispute, I bring thorough preparation, direct communication and a competitive approach to every matter.

Advising on energy and development projects

Scott counsels oil and gas companies, renewable energy developers and other sophisticated businesses on the legal and regulatory issues that can affect development projects. His work includes helping clients navigate environmental compliance, land-use requirements and potential conflicts between surface development and mineral interests, including issues arising when solar farms, wind projects and data centers converge with existing or planned oil and gas development. He particularly enjoys helping clients structure projects successfully rather than having to defend preventable problems after they become disputes.

Resolving complex property rights disputes

Much of Scott’s litigation practice centers on property-rights conflicts in which the parties can’t easily determine where their rights and duties begin and end. He advocates for clients in disputes involving oil and gas development, water rights, wellbore interference and other matters in which emerging technology and evolving development practices create questions that existing law doesn’t answer neatly. His experience also enables him to approach novel disputes from both the regulatory and litigation perspectives.

Preparing for the unexpected

Scott believes thorough preparation gives clients their best opportunity to succeed. He develops a deep understanding of each client’s business and anticipates what opposing counsel, counterparties and regulators are likely to focus on, allowing him to address concerns before they become obstacles and to neutralize potential exposure when litigation arises. He has represented clients in federal and state courts at the trial and appellate levels and routinely appears before Oklahoma’s environmental, energy and water regulators.

Drawing on extensive and diverse experience and relationships

Bringing a broad professional perspective to matters that frequently cross traditional practice-area boundaries, Scott handles matters before the Oklahoma Department of Environmental Quality, Oklahoma Corporation Commission and Oklahoma Water Resources Board. His work with these organizations, combined with his relationships throughout the energy, environmental and legal communities, gives clients access to both substantive experience and a deep network of professional resources. He personally represents clients in appeals throughout the life of their cases and approaches every proceeding with the expectation that his knowledge, skill sets and diligent work ethic should give his clients an advantage.
